Terms and Conditions

1. General Access and Usage

By engaging with any courses, advisor appointments, or community interactions offered by Whispering AI, LLC (“Whispering AI”), you accept these Terms of Service. These terms govern the use of our online courses, advisory services, and community features.

2. Course Access

  • Course Life Access: Participants will have access to purchased courses for the life of the course, commencing from the course’s launch date.
  • Copyright: All course materials are copyrighted. Unauthorized use, including reproduction, distribution, or commercial exploitation, is prohibited.

3. Advisor Appointments

  • Booking and Cancellation: Appointments can be booked through our platform. Cancellations or rescheduling are permitted up to 24 hours before the appointment without penalty. Late cancellations may not be eligible for a refund.
  • No-show Policy: Participants who fail to attend a scheduled appointment without prior notification will forfeit their appointment without a refund.

4. Community Engagement

  • Access and Guidelines: Access to our exclusive community is granted to course participants. Upon joining, members must agree to adhere to our “Community Guidelines,” which are accessible within the community space.
  • Moderation and Conduct: The community will be moderated. Regular violations of our guidelines may lead to removal by a moderator, at their discretion.
  • Public Forum: Members acknowledge that the community is a public forum. Members have no rights to any content they post and may not repurpose or redistribute content from the community.

5. Live Events and Cohorts

  • Engagement: Live events and cohorts will be announced within the community. Cohorts require a weekly subscription, with commitments to participation and scheduled activities.

6. Payments and Refunds

  • Secure Payments: We process payments securely via Stripe, ensuring transaction safety.
  • Course Refunds: A full refund is available within 72 hours of course purchase. Beyond this window, refunds are non-refundable except in extenuating circumstances, subject to our discretion.
  • Advisor Appointments and Cohorts: Specific refund policies apply as outlined in section 3.

7. Pre-sale and Course Launch

  • Notifications: Pre-sale participants will be notified on launch day with instructions for accessing courses, applicable to both new and existing accounts.

8. Service Modifications

Whispering AI reserves the right to modify or discontinue services, including course content, advisor availability, and community features, with adequate notice to participants.

9. User Conduct

Respectful and constructive engagement is expected in all courses, advisory sessions, and community interactions. Violations may lead to access suspension or termination.

10. Intellectual Property

All intellectual property rights related to the courses, advisor appointments, and community content remain with Whispering AI or its licensors. User-generated content within the community remains the property of the user, but by posting, they grant Whispering AI a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, and display the content within the community.

11. Disclaimers and Limitation of Liability

Whispering AI cannot guarantee specific outcomes from our courses, advisory sessions, or community participation. We are not responsible for external factors, such as connectivity issues, affecting access. To the extent permitted by law, Whispering AI’s liability for any damages, losses, or claims arising from the use of the services is limited. We disclaim liability for any indirect, incidental, or consequential damages.

12. Indemnification

Users agree to indemnify and hold Whispering AI harmless from any claims, damages, or expenses arising from their use of the services or violation of the Terms of Service.

13. Termination

Whispering AI reserves the right to terminate or suspend a user’s access to the courses, advisor appointments, or community at any time, for any reason, without prior notice.

14. Third-Party Links and Services

Whispering AI disclaims responsibility for any third-party links, websites, or services that may be mentioned or accessed through the courses, advisor appointments, or community.

15. Privacy Policy

Your privacy is our priority. We comply with GDPR and applicable privacy laws in handling personal data. For more details, refer to our Privacy Policy.

16. Governing Law and Dispute Resolution

These terms are governed by Arizona law, USA. Users agree to first seek informal resolution of any disputes with Whispering AI before pursuing legal action. If legal action is necessary, the jurisdiction and venue for any legal proceedings shall be in Arizona.

17. Severability and Waiver

If any provision of the Terms of Service is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Whispering AI’s failure to enforce any right or provision of the Terms of Service does not constitute a waiver of that right or provision.
